Pleural Thickening Claims

Pleural thickening compensation claims

Pleural thickening is a lung condition where the thin membrane covering the lungs (the pleura) becomes scarred and calcified. Over time, this scarring hardens and tightens, preventing the lung from fully expanding when you breathe. Unlike pleural plaques, which are often symptomless, diffuse pleural thickening can cause significant disability, including shortness of breath and chest tightness.

At WE Solicitors, we know that a diagnosis of pleural thickening often brings with it a fear of the future. You may worry that your condition will deteriorate or develop into a fatal cancer like mesothelioma. Our legal strategy addresses this fear directly. We rarely advise clients to settle these claims on a “full and final” basis. Instead, we typically seek Provisional Damages. This allows you to receive compensation for your current disability now, whilst preserving your legal right to return to court for further compensation if your condition worsens or if you develop an asbestos-related cancer in the future.

The Criteria for a Valid Claim

Not all scarring of the lung lining entitles you to compensation in England and Wales. To pursue a civil claim, your medical records usually need to show “Diffuse” Pleural Thickening. This is medically defined as extensive scarring that obliterates the costophrenic angle (the sharp angle at the bottom of the lung on an X-ray).

If your scarring is “focal” or isolated (commonly known as Pleural Plaques), you usually cannot claim compensation unless the plaques are causing significant respiratory impairment, which is rare. At WE Solicitors, our first step is to instruct a respiratory consultant to review your CT scans. They will measure the extent of the thickening to confirm it meets the legal threshold for a claim.
